Terms & Conditions

By clicking the “order” button you are agreeing to the contract and accepting our general terms and conditions. The conditional acceptance of this offer is always based on the availability of the ordered goods.

Any customer has the right to revoke their contractual statement without stating reasons, in writing within two weeks of receipt of the goods (e.g. letter, fax, email) or by returning the goods.

The period shall begin no sooner than the receipt of this instruction. In order not to exceed the cancellation period, goods must be returned or notice of cancellation given within this period.

In the event of effective cancellation, the benefits received by either party are to be returned. If you are unable to return the received benefits, be it in whole or in part or only in a deteriorated condition, you shall be liable to compensate us in an amount matching the loss in value suffered. If returning goods, the return delivery charges shall be your responsibility. The right of cancellation does not apply if the DVD seal is broken. Returned goods should be sent special delivery (from customers in Germany) or recorded delivery (from customers outside Germany). If the customer chooses an alternative delivery method, they must bear the possible additional costs.

The Unterrichtsfilmvertrieb (Educational Film Distribution) shall not be liable for any damage incurred by the customer unless caused by gross negligence or intentional conduct on our part. Contractual indemnity claims are limited to the order value of the delivery. The seller shall not be liable for damages not caused to the delivered goods themselves; in particular, it shall not be liable for any loss of profit or for other financial losses suffered by the customer. The limitation of claims of the buyer against the seller shall be one year, provided that the buyer is an entrepreneur or a public corporation.

The above sale prices include statutory VAT. Complaints regarding apparent defects are only possible within two weeks of receiving the goods. Invoices are payable and due in full within 14 days of the receipt of goods. If payments are received after this period, interest on late payments at a rate of 2% above the respective German Central Bank discount rate is due for the period of delay. Delivery costs: we charge the actual incurred costs. The delivered goods remain our property until full payment is received. Our DVDs are protected by copyright and may be used by the purchaser only in their original format within the specified terms. Any reproduction, whether it be in return for payment or not (for example, public viewing, broadcast or any other showing) or duplication/copying (for example, the recording of the material onto a blank VHS cassette, CD or DVD) may only be carried out with the formal written consent of Michael Gautsch Film Distribution. This also applies to: barter trade, repurchase, rerecording or any other commercial usage or in the acquiescence of such acts. Violators of these regulations will be prosecuted. Any person who damages, alters or reproduces this title may be liable for fraudulent misrepresentation. The resale of the DVD school licence is prohibited. Place of performance and court of jurisdiction shall, to the extent permitted by law, be Berlin. German law shall be applied. Any supplementary agreements must be confirmed in writing.
